Review of regular agenda – Mayor Alexander
REGULAR AGENDA:
Mayor Scott M. Alexander opened the regularly scheduled meeting with a salute to the flag and moment of silence.
He then stated, “In accordance with Section 5 of the Open Public Meetings Act, Chapter 231, P.L. 1975, notice of this meeting was posted on the bulletin board designed for that purpose and notice was mailed to the official newspaper provided by Resolution adopted January 3, 2009”.
Under Roll Call the following council members were present: Councilmen Daniel Haggerty, Tad Fetter and Lee Wentz, Councilwomen Rosemary Fitzgerald and Kathy Lange and Borough Solicitor Robert A. Gleaner, Esq. Councilwoman Sheilds was absent.
Mayor Alexander, Council President Fetter and Chief Kinkler presented an Honorable Service Medal to Ptl. Kevin Garemore and Camden County Investigator William Townsend.
Motion to approve the minutes from 4/7/09 was made by Councilman Haggerty, seconded by Councilwoman Sheilds. All present were in favor with the exception of Council President Fetter who abstained due to his absence at the 4/7/09 meeting.
The following Committee reports were presented:
Councilwoman Fitzgerald reported for Construction. A full copy of this report is on file with the Borough Clerk. Green Initiatives meet the 4th Monday of the Month. Councilwoman Fitzgerald read a letter she received from the State regarding transportation. Four bus shelters will be installed throughout the town. Kevin Murphy from the Delaware Valley Regional Planning Commission will give a presentation at the May 5th Council meeting regarding a grant proposal that he submitted and was accepted. Regarding Civic Events, the usual parade participants were invited and anyone is welcome to join the committee. Three historical markings will be donated by the Historical Society. May 9th is “Down by the Station Day”.
Councilwoman Lange spoke at Sterling High School with the League of Women Voters. Reporting for Parks & Recreation and the Historic Commission, report on file with the Borough Clerk. Historic Commission meets the last Thursday of the month. Rivershark tickets sales are slow; may sell at “Down by the Station” day. School Board elections are today and May 1st is the “six committee” meeting. Councilwoman Lange thanked DPW for their work at Hoff’s Park.
Councilman Wentz reported that the annual rabies clinic will be held this Saturday, April 25th from 8:30 a.m. – 9:30 a.m. The Drug Commission met last night and is working on getting sponsors for the 4th of July 5K run.
Council President Fetter reported for the Fire Department. A full copy of this report is on file with the Borough Clerk. Budget is scheduled for adoption May 5th. Please call or email him with any questions.
Councilman Haggerty reported for the Shade Tree Commission. Over the last two weeks fifty trees have been planted. All residents who received one in front of their home please remember to try and water it. Reporting for Municipal Court, Haddonfield Borough passed a resolution looking into shared services with Haddon Heights. Next step, an RFP will be issued and will become part of grant package sent to the State. Everyone has been very open-minded. Reporting for EMS, a full copy of this report is on file with the Borough Clerk. Councilman Haggerty read proclamation, attached, and will be meeting this week with Chief Zenuk and Leah Slemmer regarding budgets. He also thanked DPW for helping with the tree planting.
Councilwoman Fitzgerald spoke on behalf of Councilwoman Sheilds, thanked the Business Association for their donations for the Easter egg hunt and said that 3,000 eggs were filled for the children. A black oak tree will be planted in front of the Henchman House in honor of President Obama and slaves.
Mayor Alexander thanked DPW for helping with the tree planting and also thanked the Business Association for their donations for the Easter egg hunt. He advised that CCMUA admitted that there are issues with work they did on Sylvan Drive and they will reimburse us $19,400.00. Regarding the Citizens Advisory Committee, letters of appointment will be sent out later in the week. Mayor thanked them for their support.
With no further reports to be presented Mayor Alexander called for remarks from the public on New Business agenda items.
Terry Chepurny, 1643 Sycamore Street commented on Resolution 2009:1307, asking why there is money for repairs and to hire a part time official when there is still no stop sign at Glenview Avenue School. Mayor Alexander responded that we have received approval for Pennoni Associates to perform a traffic study to make that determination.
OLD BUSINESS:
Public Hearing and Final Adoption of Ordinances 2009:1299, 1300, 1301, 1302, 1303, 1304, 1305 and 1306.
Ordinance 2009:1299 – An Ordinance Amending Chapter 175 of the Code Entitled Construction Codes, Uniform (Amending fees for various permits.)
Hearing or seeing no comments from the public, motion to close the public hearing was made by Councilman Haggerty, seconded by Councilman Wentz. All members present were in favor.
Motion to adopt Ordinance 2009:1299 was made by Councilwoman Fitzgerald, seconded by Councilman Haggerty. All members present were in favor.
Ordinance 2009:1300 – An Ordinance Amending Chapter 205 of the Code Entitled Dumpsters (amending the chapter to include storage containers.)

Motion to adopt Ordinance 2009:1300 was made by Councilwoman Fitzgerald, seconded by Council President Fetter. All members present were in favor.
Ordinance 2009:1301 – An Ordinance Amending Chapter 213 of the Code Entitled Fees (Amending fees for dumpster or storage container, seasonal temporary tents or structures, sidewalk construction permit, curb breaking permit fee, installation of swimming pools, all fences, walls under 48”, variance and zoning applications. Also deletes Oil Burner Installation permit, installation of swimming pools (duplicate) and also signs which require a license.)
Barbara Cortese, 325 Third Avenue asked for clarification of the tents. Solicitor Gleaner and Mayor Alexander read Section 337-20 of Borough Code and explained that this Ordinance pertains to seasonal temporary commercial tents and that the information in the Code has not changed; only the fees.

Motion to adopt Ordinance 2009:1301 was made by Councilwoman Fitzgerald, seconded by Councilman Haggerty. All members present were in favor.
Ordinance 2009:1302 – An Ordinance Amending Chapter 326 of the Code Entitled Parks & Recreation Areas (Sets restrictions on conduct, hours, permits for use of fields for athletic activities and for special events, disposal areas, and sets violations and penalties for violating any portion of this ordinance.)
Gregg Gardner, 125 Third Avenue is concerned with the wording in this Ordinance on who has the authority to approve or revoke the use of the properties. Discussion ensued between Mr. Gardner and Council members.
Rickie Roberts, 127 Third Avenue also commented on the Ordinance.
Motion to TABLE Ordinance 2009:1302 was made by Councilwoman Lange, seconded by Councilman Wentz. All members present were in favor.
Ordinance 2009:1303 – An Ordinance Amending Chapter 59 of the Code Entitled Officers and Employees (Removing Oil Burner Inspector position and adding Operations Manager position.)

Ordinance 2009:1305 – An Ordinance Amending Article III, Chapter 400 of the Code Entitled Sidewalk Construction and Repair (Adding driveway apron and distribution of permit guidelines.)

Ordinance 2009:1306 – An Ordinance Amending Chapter 450 of the Code Entitled Zoning and Land Development (Zoning application to be submitted to Zoning Enforcement Officer to determine if request is in compliance with the Code of the Borough of Haddon Heights. Swimming pools cannot be constructed on a lot unless there is an occupied residence on such lot. No person shall erect a fence or wall until after obtaining a permit from the Construction Department.)

NEW BUSINESS:
Introduction of Ordinances 2009:1307 and 1308. Public hearings and final adoptions scheduled for 7:00pm May 5, 2009.
Ordinance 2009:1307 – Bond Ordinance for Capital Projects. (Repair/replace Municipal Bldg. roof, renovations to Mayor’s office, improvements to underground storage tank, various equipment for DPW including trash can lids and signage hardware, various improvements to the existing sewer system, improvements to parks and recreation fields, acquisition of various pieces of computer equipment )
Motion to introduce Ordinance 2009:1307 was made by Council President Fetter, seconded by Councilman Haggerty. Under roll call, all members present were in favor.
Ordinance 2009:1308 – An Ordinance Amending Chapter 393 of the Code of the Borough of Haddon Heights Entitled Solid Waste. (Recycling can be placed in one container, but separate from trash; separate container must be used for household trash/garbage. Containers are not to be placed in the street or on the sidewalk. Any bulk materials not in containers (fencing, branches, posts, etc.) shall be cut and bundled in lengths no longer than 48”. For brush or branches, all ends shall face the same direction. No materials, including but not limited to, brush, grass clippings, concrete, or construction materials, may be put out for disposal, that was NOT generated from that location. Landscapers are required to dispose of all brush, clippings, etc. off site. Contractors are responsible for removing all trash and debris generated from construction or repairs from the property.)

Resolution 2009:107 – Resolution Appointing Additional members to the Green Initiatives Committee. ( Full list of committee: Councilwoman Rosemary Fitzgerald, Judy Barnes, Janice Bergbauer, Terre Boccuzzi, Jan Ewing, Marshall Hatfield, Craig Huber, Jay Jones, Joe McAndrew, John McClafferty, Kevin Murphy, Roni Olizi, Joe Orlando, Al Oswald, Thomas Ottoson, Richard Quinn, Mitch Teplick and Bill Troutman.)
Motion to adopt Resolution 2009:107 was made by Councilman Wentz, seconded by Council President Fetter. All members present were in favor.
Mayor Alexander issued the Oath of Office to new Green Initiatives Committee members present.
Resolution 2009:108 – Resolution Approving a Shared Services Agreement with the County of Camden and Borough of Haddon Heights. (For an armored vehicle to be used by Zone 5 tactical team members.)
Motion to adopt Resolution 2009:108 was made by Council President Fetter, seconded by Councilwoman Fitzgerald. All members present were in favor.
Resolution 2009:109 – Resolution Approving Payment of Bills and Claims for 2nd Half of April.
Motion to adopt Resolution 2009:109 was made by Councilman Wentz, seconded Council President Fetter. Under roll call, all members present were in favor.
Resolution 2009:111 – Borough of Haddon Heights Temporary Budget Appropriation Increase for 2009 ($750 S/W, $33,100 O/E.)
Motion to adopt Resolution 2009:111 was made by Councilman Haggerty, seconded by Council President Fetter. Under roll call, all members present were in favor.
Resolution 2009:112 – Resolution Awarding a Contract to Charles Marandino, LLC, in the Amount of $210,244.20 for the Historic Railroad Corridor Enhancements Project.
Motion to adopt Resolution 2009:112 with amendment changing amount to $210,244.20 was made by Councilwoman Fitzgerald, seconded by Council President Fetter. Under roll call vote, all members present were in favor.
With no further business to come before council, Mayor Alexander opened the meeting for comments and concerns.
Terry Chepurny, 1643 Sycamore Street stated that she is concerned with the purchase of the American Water Company property; that it is not appropriate at this time and feels that our COAH obligations will increase.
Karyn Errington, 1645 Sycamore Street commented that she does not agree with using the DPW site for affordable housing; it would be extremely difficult.
Mayor Alexander suggested that Ms. Chepurny and Ms. Errington go back and read the Project Garnet presentation that was given at the April 7th meeting and is now on our website; and stated that we are not using the DPW site for affordable housing. The State has requirements regarding affordable housing and we have an obligation to fulfill, regardless of selling the DPW property. Discussion ensued between Ms. Chepurney and Council Members regarding COAH, budget and contamination.
Jim Jensen, 1413 Sycamore Street commented on the basketball net Ordinance. Solicitor Gleaner advised Mr. Jensen that he has seen the information he had sent to Councilwoman Fitzgerald and will try to incorporate that into an amendment to the Ordinance that he is about to draft. Anyone interested in forwarding their suggestions may email him.
