CAUCUS:

Review of regular agenda – Mayor Alexander

Presentation on Traffic Taming Study – Councilwoman Fitzgerald introduced Kevin Murphy and Kelly Rossiter from DVRPC. They presented a power point presentation on traffic calming initiatives along East Atlantic Avenue.

REGULAR AGENDA:

Mayor Scott M. Alexander opened the regularly scheduled meeting with a salute to the flag and moment of silence.

He then stated, “In accordance with Section 5 of the Open Public Meetings Act, Chapter 231, P.L. 1975, notice of this meeting was posted on the bulletin board designed for that purpose and notice was mailed to the official newspaper provided by Resolution adopted January 3, 2009”.

Under Roll Call the following council members were present: Councilmen Daniel Haggerty and Tad Fetter, Councilwomen Rosemary Fitzgerald, Trish Sheilds and Kathy Lange and Borough Solicitor Robert A. Gleaner, Esq. Councilman Lee Wentz and Borough Clerk were absent.

Motion to approve the minutes from 5/5/09 was made by Councilwoman Fitzgerald, seconded by Councilman Haggerty. All members present were in favor.

The following Committee reports were presented:

Council President Fetter reported that Governor Corzine proposes to suspend Homestead Rebates for everyone except seniors due to the worst decline in history.

Councilman Haggerty reported for Municipal Court. Regarding the Municipal Court study, Haddonfield has issued an RFP. The proposal looks good. The next step is making an application for the grant.

Councilwoman Sheilds had nothing to report.

Councilwoman Fitzgerald reported for Community Wellbeing. On June 16th there will be a Recollection of the Great Depression and on June 18th at 1:00 p.m. there will be a senior citizens luncheon held at Kunkel’s. If all goes well, it will continue. “Down by the Station” was a huge success.

Councilwoman Lange reported for Parks & Recreation and the Historic Commission; report on file with the Borough Clerk.

Mayor Alexander reported that “Down by the Station” was an excellent event and he also thanked Council for a great job with their committees.

With no further reports to be presented Mayor Alexander called for remarks from the public on New Business agenda items.

There were none.

OLD BUSINESS:

Public Hearing and Final Adoption of Ordinances 2009:1309 and 1310.

Ordinance 2009:1309 – Bond Ordinance Authorizing the Acquisition, Improvements and Materials for Real Property in the Borough of Haddon Heights. ($1,313,000 for the acquisition of Real Property, commonly referred to as 514 W. Atlantic Avenue, Block 50, Lots 8 & 9 and all materials and equipment and completion of all work necessary to become a municipal facility.)

Tom Ferrese, 413 Second Avenue, as Chairman of the Planning Board this plan concept has been in the Master Plan for many years. The plan has many advantages. It is a very good sign when you see local government become more self-sufficient. As Planning Board Chairman, this is an excellent idea.

Councilwoman Sheilds asked if the remediation study is complete. Mayor Alexander responded that the Phase 1 study has been done and we’re waiting to hear back from the State.

Hearing or seeing no additional comments from the public, motion to close the public hearing was made by Councilman Haggerty, seconded by Council President Fetter. All members present were in favor.

Motion to adopt Ordinance 2009:1309 was made by Council President Fetter, seconded by Councilwoman Fitzgerald. Under a roll call vote, all members present were in favor with the exception of Councilwoman Sheilds who voted no.

Ordinance 2009:1310 – An Ordinance Amending Chapter 100, Section 18 of the Code of the Borough of Haddon Heights Entitled Vehicles and Traffic. (Adds two 4-way stop intersections at Glenview Avenue and West High Street and Glenview Avenue and Sycamore Street.)

Hearing or seeing no comments from the public, motion to close the public hearing was made by Councilwoman Sheilds, seconded by Councilwoman Fitzgerald. All members present were in favor.

Motion to adopt Ordinance 2009:1310 was made by Council President Fetter, seconded by Councilwoman Sheilds. All members present were in favor.

NEW BUSINESS:

Resolution 2009:120 – Resolution Authorizing Payment to Judy Bitner for 57.5 Sick Days Accumulated as of 12/31/06 at Her 2006 Rate and 25 Unused Vacation Days Earned in 2009 at Her 2007 Rate Totaling $10,369.32. (Judy is retiring effective June 1st after serving 15 years with the Borough and is entitled to the above per the Personnel Policies and Procedures Manual.)

Motion was made by Councilman Haggerty to adopt Resolution 2009:120, seconded by Councilwoman Sheilds. Under a roll call vote, all members present were in favor.

Resolution 2009:121 – Resolution Authorizing Refund of Tax Overpayment in the Amount of $1,428.40. (Overpayment due to refinancing, the sale of property or duplicate payment made by both the title and mortgage companies.)

Motion was made by Council President Fetter to adopt Resolution 2009:121, seconded by Councilwoman Fitzgerald. Under a roll call vote, all members present were in favor.

Resolution 2009:122 – Resolution of the New Jersey Department of Transportation Division of Local Aid and Economic Development Recommendation of Award for State Aid Project. (American Asphalt Company, Inc. of West Collingwood, NJ, to be awarded a contract for the project known at 2008 Road Program in the amount of $269,853.35, subject to approval by the NJDOT.)

Motion was made by Councilwoman Fitzgerald to adopt Resolution 2009:122, seconded by Councilman Haggerty. Under a roll call vote, all members present were in favor.

Resolution 2009:123 – Resolution Authorizing the Payment of Bills and Claims for 2nd Half of May.

Motion was made by Councilwoman Lange to adopt Resolution 2009:123, seconded by Councilwoman Fitzgerald. Under a roll call vote, all members present were in favor.

Resolution 2009:124 – Resolution Appointing Barbara Newell to the Parks & Recreation Committee.

Motion was made by Councilwoman Sheilds to adopt Resolution 2009:124, seconded by Councilwoman Lange. All members present were in favor.

Resolution 2009:125 – Resolution Approving Chapter 159. ($12,026.61 received from Clean Communities which was received after budget was adopted. This resolution allows us to include the amount in revenues and set up an appropriation for Clean Communities activity.)

Motion was made by Council President Fetter to adopt Resolution 2009:125, seconded by Councilwoman Sheilds. Under a roll call vote, all members present were in favor.

Resolution 2009:127 – Resolution Amending Resolution 2009:112 (Correction in amounts regarding the Historic Railroad Corridor Enhancements. Bid specifications should not have included lighting; Charles Marandino, LLC is still the lowest qualified bidder)

Motion was made by Council President Fetter to adopt Resolution 2009:127, seconded by Councilman Haggerty. Under a roll call vote, all members present were in favor.

With no further business to come before council, Mayor Alexander opened the meeting for comments and concerns.

There were none.

Resolution 2009:126 – Resolution Providing for a Meeting Not Open To the Public In Accordance With the Provisions of the New Jersey Open Public Meetings Act, N.J.S.A. 10:4-12. Formal action may be taken after closed session which will be open to the public. (Matters relating to collective bargaining agreements; Matters relating to the purchase, lease or acquisition of real property or the investment of public funds; Matters relating to litigation, negotiations and the Attorney-Client Privilege)

Motion was made by Councilman Haggerty to adopt Resolution 2009:126, seconded by Council President Fetter. All members present were in favor.

Closed session:  Present were Councilpersons Fetter, Fitzgerald, Lange, Haggerty and Sheilds, Mayor Alexander, Deputy Clerk Holcombe and Solicitor Gleaner.  Councilman Wentz was absent. 

Discussion ensued concerning matters relating to collective bargaining agreements; matters relating to the purchase, lease or acquisition of real property or the investment of public funds; and matters relating to litigation, negotiations and the Attorney-Client Privilege.  No formal action was taken.

Motion was made by Council President Fetter to adjourn the closed session and open the meeting to the public, seconded by Councilwoman Sheilds. All members present were in favor.

Ordinance 2009:1311 – An Ordinance Fixing and Determining the Salaries, Wages or Compensation to be Paid to the AFSCME Union Employees of the Borough of Haddon Heights for the Years 2008 (Retroactive) and 2009

Motion was made by Councilman Haggerty to introduce Ordinance 2009:1311, seconded by Councilwoman Sheilds. Under a roll call vote, all members present were in favor.

Resolution 2009:128 – Resolution Authorizing Borough Solicitor to Draft a Contract to be Entered Into With New Jersey American Water Company (Authorizes the Solicitor to prepare a contract for the purchase of Block 50, Lots 8 & 9 for the purchase price of $510,000; said contract to include a clause allowing for a 21 day due diligence period as a contingency)

Motion was made by Council President Fetter to adopt Resolution 2009:128, seconded by Councilman Haggerty. Under a roll call vote, all members present were in favor with the exception of Councilwoman Sheilds who voted no.

Resolution 2009:129 – Resolution Authorizing Borough Solicitor to Enter Into Negotiations for the Sale of Block 27, Lot 1, the Southwest Corner of West Atlantic Avenue and Kings Highway, Haddon Heights (Authorizes the Solicitor to enter into negotiations for the sale of Block 27, Lot 1 for a sale price of $240,000 with a contract requirement and ultimate deed restriction allowing for the continued no-cost use by the American Legion, upon sale of the premises)

Motion was made by Councilman Haggerty to adopt Resolution 2009:129, seconded by Councilwoman Fitzgerald. Under a roll call vote, all members present were in favor with the exception of Councilwoman Sheilds who voted no.

Motion to adjourn was made by Councilwoman Sheilds, seconded by Council President Fetter. All members present were in favor.
